International Aviation Law & Policy - European Aviation Regulations

Course content

Day 1 

The EU approach to liberalization of intra-Community (international) air transport:

  1. Pre-liberalization: bilateralism, inter-airline cooperation (‘pool’) agreements & government controls
  2. The EU – organization & rulemaking
  3. Transport & competition provisions of the Rome Treaty
  4. The European Court’s judgments: the legal basis for liberalization (e.g. Nouvelles Frontieres)
  5. The Third Package: Regulations on licensing, market access & tariffs – effects on intra-EU air transport
  6. EU policies re State aid/subsidies to airlines & airports
  7. Application of EU competition law to alliances and mergers of EU airlines (e.g. Air France/KLM case)
  8. Protection of passenger rights: denied boarding etc., passengers with reduced mobility; ‘blacklisting’ of airlines; price transparency
  9. Airport-related issues: slot allocation, ground handling.

 

Day 2

EU aviation relations with third countries:

  1. Pre-ECJ judgment: Community external competence and the U.S.
  2. The 2002 ECJ ‘Open Skies’ judgment: parties, issues, outcome
  3. Commission’s follow-up initiatives: 2 mandates and 1 Regulation
  4. EU – US 1st stage Air Transport Agreement 2007  + Protocol 2010: contents & effects
  5. ‘Horizontal agreements’: review of provisions, practical effects
  6. Member States’ and Community’s competencies & responsibilities under Reg. 847/2004
  7. ‘Non-discriminatory allocation of limited traffic rights’ – national policies/practices – effects
  8.  EU ‘comprehensive’ agreements with third countries: Morocco, Jordan, Canada, Georgia etc. and prospects for new ‘vertical’ mandates
  9. Other agreements with Switzerland, Russia (Siberian royalties), ECAA/Balkan, Euromed countries etc.
  10. EU and ICAO;  prospects for enhanced EU role in international aviation

Course prerequisites

(Some) practical experience in the field of international aviation and/or knowledge of international law/relations is desirable but not essential.
